UK inquiry into extension of resale right to dead artists
The UK Intellectual Property Office is currently undertaking several public consultations, including one on the application of the artists’ resale royalty right to works of deceased artists.
The Directive 2001/84/EC on the resale right for the benefit of the author of an original work of art was implemented in the UK in 2006. At that time, the government relied on a derogation in the Directive to limit the application of the right to the works of living artists.
The derogation will expire on 1 January 2010, extending the application of the right to works of deceased artists, unless a two-year extension is sought under the terms of the Directive.
Submissions to the UK-IPO are due by 22 September 2008.
