2006 copyright amendments
Dec 07  This new book covers the important amendments to the Copyright Act in December 2006. They include new exceptions allowing time-shifting of tv programs for private use, space-shifting of recorded music (from CD to iPod, for example) and format-shifting of photographs, books and videos. Other changes include new exceptions for educators, libraries, galleries, museums and people with a disability; new anti-piracy measures; changes relating to technological protection measures; and changes to the jurisdiction of the Copyright Tribunal.

Gaining access to copyright material in the digital context has become contentious. This is because copyright owners are increasingly providing access to their material in ways that are subject to:
  • contractual terms and conditions; and/or
  • digital “locks” and other “technological protection measures”.
In each case, users of copyright material have become concerned that their ability to rely on the various “exceptions” to copyright infringement which are in the Copyright Act are eroded, and effectively replaced by the terms and conditions of contractually enforceable licence agreements.
This discussion paper reviews the debate and reviews the legislation, including the relevant provisions in the Copyight Amendment Act 2006.

As a result of Parliamentary inquiries into the Australia–US Free Trade Agreement, the Government began an inquiry in 2005 into whether or not the Australian Copyright Act should be amended to include an exception to copyright infringement for “fair use”, similar to that in US copyright law. The inquiry is particularly concerned with private copying of music and television programs, and use of copyright material by educational institutions, libraries and other collecting institutions. At the time of writing, the inquiry had not concluded. This discussion paper looks at the background to the inquiry, the international context, and an analysis of various submissions to the inquiry.order online
